Land is owned by the entire people with the State representing the owner and uniformly managing it. The State grants land use rights to land users according to regulations.
1. Basis for determining land type
Based on the purpose of use, land is classified into agricultural land groups, non-agricultural land groups, and unused land groups. (Clause 1, Article 9 of Land Law 2024)

2. Soil classification
Based on the purpose of use, land is divided into the following 3 groups:
2.1. Agricultural land group
– Land for growing annual crops, including land for growing rice and land for growing other annual crops;
– Land for growing perennial crops;
– Forestry land, including special-use forest land, protective forest land, and production forest land;
– Aquaculture land;
– Concentrated livestock land;
– Soil for salt production;
– Other agricultural land.
2.2. Non-agricultural land group
– Residential land, including rural residential land and urban residential land;
– Land for construction of agency headquarters;
– Land used for national defense and security purposes (hereinafter referred to as national defense and security land);
– Land for construction of non-business projects, including: land for construction of cultural, social, medical, educational and training facilities, physical training, sports, science and technology, environment, hydrometeorology , diplomatic and other public service projects or land to build headquarters of other public service units;
– Land for non-agricultural production and business, including: land for industrial parks and industrial clusters; commercial and service land; land for non-agricultural production establishments; land used for mineral activities;
– Land used for public purposes, including: land for traffic works; irrigation works land; land for water supply and drainage works; land for natural disaster prevention and control works; land with historical-cultural relics, scenic spots, and natural heritage; land for waste treatment works; Land for energy projects and public lighting; land for postal, telecommunications, and information technology infrastructure; land for residential markets and wholesale markets; Land for public entertainment, recreation, and community activities;
– Land used for religious activities (hereinafter referred to as religious land); land used for religious activities (hereinafter referred to as religious land);
– Cemetery land, funeral homes, cremation facilities; Base land for storing ashes;
– Land with specialized water surface;
– Other non-agricultural land.
2.3. Unused land group
Unused land group is land whose use purpose has not been determined and has not yet been allocated or leased.
