Responsibilities of competent persons in selecting contractors and investors are specified in Article 73 of the 2013 Bidding Law, specifically as follows:
1. Approve plans for selecting contractors and investors, except for the cases specified in Point a, Clause 1, Article 74 of this Law.
2. Resolve complaints during the process of selecting contractors and investors.
3. Handle violations of bidding according to the provisions of this Law and other relevant laws.
4. Cancel the bid according to the provisions of Clauses 2, 3 and 4, Article 17 of this Law.
5. Suspend the bidding, do not recognize the results of contractor or investor selection or declare invalid the decisions of the investor or the party soliciting bids when detecting any violations of bidding or other relevant legal provisions.
6. Organize inspection, supervision, and monitoring of bidding and contract implementation.
7. Regarding contractor selection, in addition to the provisions in Clauses 1, 2, 3, 4, 5 and 6 of this Article, the competent person also has the following responsibilities:
a) Adjust the duties and authority of the investor in case of failure to meet the provisions of law on bidding and the requirements of the project or bidding package;
b) Request the investor and bid solicitor to provide records and documents to serve the work of inspection, supervision, monitoring, resolving complaints, handling violations of bidding and work specified in Clause 1 of this Article. Clauses 4 and 5 of this Article;
c) Have opinions on the handling of complicated situations at the request of the investor specified in Point a, Clause 2, Article 86 of this Law.
8. Regarding investor selection, in addition to the provisions in Clauses 1, 2, 3, 4, 5 and 6 of this Article, the competent person also has the following responsibilities:
a) Decide on the selection of the bidding party;
b) Approve pre-qualification documents, pre-qualification results, bidding documents, request documents, investor selection results;
c) Decide to handle the situation;
d) Sign and manage contract implementation;
d) Cancel the bid according to the provisions of Clause 1, Article 17 of this Law;
e) Request the bidding party to provide records and documents to serve the work of inspection, supervision, monitoring, resolving complaints, and handling violations regarding bidding and work specified in Clause 4 and Clause 1 of this Article. 5 This.
9. Decide to establish a bidding party with personnel who meet the conditions prescribed by this Law for investor selection and regular procurement. In case the personnel do not meet the requirements, a professional bidding organization must be selected to act as the bidding party or perform some of the bidding party’s tasks.
10. Compensate for damages according to the provisions of law to relevant parties if such damage is caused by your fault.
11. Explain the implementation of the provisions in this Article at the request of superior agencies, inspection agencies, and state management agencies on bidding activities.
12. Perform other responsibilities according to the provisions of this Law.
