Fertilizer is a product that provides nutrients or improves soil quality to increase productivity and quality for crops.
1. Conditions for trading fertilizers
According to Article 42 of the 2018 Law on Crop Production regarding the conditions for trading fertilizers, organizations and individuals trading fertilizers must have a certificate of eligibility for trading fertilizers; in case of trading fertilizers produced by themselves, they do not need to have a certificate of eligibility for trading fertilizers.
The conditions for granting a certificate of eligibility for trading fertilizers include:
- Having a legal and clear trading location;
- Having full records, documents tracing the origin of fertilizers according to regulations;
- The person directly trading fertilizers must be trained and specialized in fertilizers according to the guidance of the Ministry of Agriculture and Rural Development, except for cases where they have a degree from intermediate level or higher in one of the fields of crop cultivation, plant protection, soil science, agriculture, chemistry, biology
2. Documents and procedures for granting a certificate of eligibility for trading fertilizers
2.1. Composition of the dossier
According to the provisions of Article 15 of Decree 84/2019/ND-CP and Clause 1 of Article 1 of Decree 130/2022/ND-CP on the dossier for granting a certificate of eligibility for trading fertilizers, the dossier includes:
Application for a certificate of eligibility for trading fertilizers according to Form No. 08 in Appendix I issued together with Decree 84/2019/ND-CP.
Information on the certificate of training and specialization in fertilizers is shown in the application for a certificate of eligibility for trading fertilizers or a copy of the intermediate or higher graduation diploma of the person directly trading fertilizers according to the provisions at Point c, Clause 2, Article 42 of the 2018 Law on Crop Production.

2.3. Deadline for settlement
Within 10 working days from the date of receiving the complete dossier, the competent authority shall appraise the contents of the dossier. If the dossier meets the requirements, the conditions for trading fertilizers shall be checked at the organization or individual, and an inspection record shall be made.
In case the organization or individual trading fertilizers does not meet the conditions, they must take remedial measures. After remedying, they must notify the competent authority in writing to check the remedied contents.
In case the inspection result meets the requirements, within 03 working days from the end of the inspection, the competent authority shall grant a certificate of eligibility for trading fertilizers. In case the certificate of eligibility for trading fertilizers is not granted, a written reply must be given stating the reason.
