1. What is nightclub service?
Nightclub service is a service that provides dance floors, stages, sound systems, and lighting for dancing, singing, or artistic performances at establishments that meet the legal requirements for operating nightclub services according to Decree 54/2019/ND-CP. (Article 2, Clause 2 of Decree 54/2019/ND-CP)
2. Principles of operating nightclub services
According to Article 3 of Decree 54/2019/ND-CP, the principles for operating karaoke and nightclub services are as follows:
– Enterprises or individuals can only operate nightclub services after obtaining a business license that meets the necessary conditions as stipulated in Decree 54/2019/ND-CP and other relevant laws and regulations.
– Ensure security, social order, and the safety, health, dignity, and property of organizations and individuals participating in nightclub activities.
– Do not exploit business activities for the generation of social vices, crimes, or other illegal activities.
3. Conditions for operating nightclub services
The conditions for operating nightclub services are regulated in Article 5 of Decree 54/2019/ND-CP, specifically:
– Being an enterprise or individual business entity established in accordance with the law.
– Complying with conditions related to fire prevention, explosion prevention, security, and order as specified in Decree 96/2016/ND-CP, which stipulates security and order conditions for certain conditional investment and business sectors.
– The nightclub venue must have a usable area of at least 80 square meters, excluding auxiliary works.
– Not placing locks or alarm devices inside the nightclub venue, except for fire alarm devices.
– The business location must be at least 200 meters away from schools, hospitals, religious facilities, cultural sites, and historical relics.
4. Responsibilities of businesses, individuals when operating nightclub services
– General responsibilities of businesses, individuals when operating nightclub services:
+ Comply with labor laws regarding employees as stipulated by the law. Provide uniforms and name badges for employees.
+ Ensure adequate soundproofing and sound emission from the singing room or nightclub venue, in accordance with the National Technical Standards for noise.
+ Adhere to regulations under Decree 105/2017/ND-CP regarding liquor business.
+ Comply with laws and regulations related to smoking hazards.
+ Comply with environmental protection laws, food safety and hygiene, copyright, labor contracts, occupational safety, insurance, social vices prevention, and other relevant laws and regulations.
– Responsibilities of businesses, individuals when operating nightclub services:
+ Not operate between 2 am and 8 am.
+ Not provide nightclub services to individuals under 18 years old.
+ In the case of artistic performances, comply with the regulations regarding artistic performances as stipulated by the law.
